    Check My NFA Logic

    I have 2 MCX Spear LT lowers - one an 11.5” pistol, and the other a 16” rifle. One is going to get a Form 1.

    It seems like I should Form 1 the lower that came with the 16” rifle and keep the 11.5’” lower a pistol that can be used with a brace when I travel across state lines. I base this on an understanding that rifles lowers cannot be used with a brace and a barrel less than 16”, right?
    I like my rifles like my women - short, light, fast, brown, and suppressed.

    If you want to be able to take one of those firearms across state lines while it's using a short barrel without filing a 5320.20, then it has to be a pistol. And a firearm that started out life as non-NFA rifle can't ever have a barrel shorter than 16", and it can't ever be turned into a pistol. So you're correct, form 1-ing the 16" rifle would be the best choice. Then either lower could legally have either upper attached to it.
