Even if ATF wanted to "gotcha" people like this getting an Assistant U.S. Attorney and a U.S. Magistrate on board with prosecuting people who were making reasonable efforts to comply with a new legal provision based on a "timed out" background check is a non starter. That's if this 88 day thing is even real and not simply a GOA fundraising boogeyman.

    I watched this video yesterday discussing 26 USC 5848 and how information given to the AFT in the form 1 application cannot be used as evidence against the applicant.

    (a) General rule

    No information or evidence obtained from an application, registration, or records required to be submitted or retained by a natural person in order to comply with any provision of this chapter or regulations issued thereunder, shall, except as provided in subsection (b) of this section, be used, directly or indirectly, as evidence against that person in a criminal proceeding with respect to a violation of law occurring prior to or concurrently with the filing of the application or registration, or the compiling of the records containing the information or evidence.
    (b) Furnishing false information

    Subsection (a) of this section shall not preclude the use of any such information or evidence in a prosecution or other action under any applicable provision of law with respect to the furnishing of false information.

    I am not a lawyer but could it be used in civil forfeiture proceedings vs someone who applied for an amnesty stamp for a foreign brace pistol?

    i.e. they can't use it to prosecute for the SBR or 922r but could they use it in a civil forfeiture proceeding to get a court order to compel destruction/ surrender or seizure of the gun as contraband?

    Is the thinking that imported pistols are a problem under the new rule or just a theoretical concern based on interpretation?
