    The idea of constructive intent is ridiculous. The list of possibilities seems endless. As long as the tax is paid, the "crime" literally gets the stamp of approval.

    RE = receiver extension, what is commonly called a buffer tube. Yeah, it’s ridiculous but it’s also a thing, at least as an add-on charge in some cases from what I can tell. I highly doubt someone would have a primary prosecution of constructive intent without first being a serious dirtbag, but IANAL nor do I live in a fun state like NY or CA.

    My view of the recent Supreme Court decision restricting the power of the EPA leads me to think that the same principle- that a federal agency cannot imperate rules using ungranted power that belongs to Congress- could well be applied to ATF.

    We will just have to see how this goes.
