    Brian Fletcher, Principal Deputy U.S. Solicitor General, is much (much) more impressive than the New York SG. Making the best case for tyranny that can be made.

    Agreed. Listening now.

    I’m impressed by Clement.

    Completely unimpressed by the NY SG.

    Fletcher is much more what expected in a SCOTUS argument.

    Clement extremely strong on rebuttal right now. Really taking apart every key point made by NY and US.

    I forgot to mention above..

    Did anyone else notice that Justice Clarence Thomas asked several questions?
    My understanding is that he often goes an entire session (as in a year) without asking a question.
    Seems to me that this is an important case to him.

    If I'm recalling correctly, this started last year when oral argument was on Zoom.

    Everything else aside, he has such a great voice.

    My understanding is that Justice Thomas really did not care for the free-for-all questioning and did not like how that treated litigants and the other Justices, as folks often got talked over. He apparently much prefers the current method of allowing litigants to make their argument and having an organized questioning session. Having been there in another context, frankly so do I.
