If a rifle was illegally transferred and there was no body charged by the fed did it actually happen? Probably, but who cares?

The first statement he made was as a candidate. AFAIK, that doesn't give him any sort of immunity. Would such a lawsuit have to wait until he was no longer president? I dont know. Probably.

I don't think it would have to wait under Clinton v. Jones.

The Court held that unofficial acts prior to taking office are not subject to temporary immunity, and that absent a federal statute requiring a delay of proceedings, a sitting president cannot simply get a stay until exiting office.
