    Maybe. My dim recollection is that all appeals have to go to a panel, but en banc hearings are discretionary.

    The SC won't take it until a majority of states pass a magazine ban. That's what happened when the SC was finally forced to make a ruling on SSM.

    CA just has to let it go. Sometimes you can just push these things too far. Going to the SC is like a double or nothing bet. You could lose it all and take a whole bunch of AG supporters down with you.

    I dare the those bastards in CA to appeal this.

    Fingers crossed. IIRC, isn't the 9th now evenly split with R/D appointees with one open spot?
