    ACLU questions Rhode Island cops stopping NY cars

    The American Civil Liberties Union of Rhode Island is questioning the constitutionality of Gov. Gina Raimondo's directive allowing state police to stop vehicles with New York license plates.

    The Democratic governor on Thursday called the measure extreme but pointed out New York City is the epicenter of the disease in the United States.

    Steven Brown, executive director of the ACLU of Rhode Island, says while Raimondo has the authority to suspend some state laws and regulations to address a medical emergency, she cannot suspend the Constitution.

    He says under the Fourth Amendment, having a New York state license plate “simply does not, and cannot, constitute ‘probable cause’ to allow police to stop a car and interrogate the driver, no matter how laudable the goal of the stop may be.”

    So, I’d say they’re not technically tracking the devices...They’re probably looking at movements through advertiser/fog data, which doesn’t require a search warrant. You’re just looking at an advertiser ID, basically, which is anonymous. It takes a search warrant to get the person’s information.

    @TC215 not to mention the amount of stuff that people volunteer with their identity attached to it, which can be aggregated, as well as other sources playing into this effort like ALPRs.

    Media keeps pressing for the Federal government to do more - be careful what you wish for. Our Nations system emphasizes local response augmented through state then nation.

    Government Tracking How People Move Around in Coronavirus Pandemic

    Government officials across the U.S. are using location data from millions of cellphones in a bid to better understand the movements of Americans during the coronavirus pandemic and how they may be affecting the spread of the disease.

    The federal government, through the Centers for Disease Control and Prevention, and state and local governments have started to receive analyses about the presence and movement of people in certain areas of geographic interest drawn from cellphone data, people familiar with the matter said. The data comes from the mobile advertising industry rather than cellphone carriers.

    The aim is to create a portal for federal, state and local officials that contains geolocation data in what could be as many as 500 cities across the U.S., one of the people said, to help plan the epidemic response.
