FWIW, this guy was convicted of a summary offense- the lowest grade of crime in PA. Summary offenses are like traffic tickets- he was issued a non-traffic citation (ticket.) The original court- a local magistrate, after a summary hearing found the defendant guilty and sentenced him to pay a fine of $100.00 plus court costs.
Defendant appealed his conviction. After a new hearing, the county judge found him guilty. Same fine & costs imposed.

Mr Klingseisen also said that Kirchner's gun-like hand gesture made him feel "extremely threatened," according to testimony.
Apparently if you provoke someone with the bird hand gesture, you are OK. Maybe Kirchner should have said he felt extremely threatened with Klingseisen's gesture and acted in self defense.
Kirchner, wearing basketball shorts and flip-flops, said that when he stopped, Mr Klingseisen flipped him the bird - "with both hands," he testified.
