    OH - READ THIS ARTICLE.

"When he arrived home, his family was being held hostage," McCauley said.

Deputies were alerted to the shooting at 3:44 p.m. via a 911 call from the victim's wife.

According to a press release issued by the sheriff's office, the victim was reportedly confronted by the assailant in his driveway.

The assailant was armed and pointed the gun at the victim while ordering him inside the residence.

Once inside the home, the victim was ordered downstairs, at which time he was reportedly shot in the back by the assailant while walking down the stairs.

The victim was then able to return fire.

"The victim managed to get a firearm and he returned fire," striking the shooter, McCauley said.
Quoting this blurb from Buckeye Firearms.
Although authorities did not release what type of weapons were used in the shootings, a former student of mine who is related to the victims in this case informed me that the attacker had a shotgun loaded with deer slugs, and the defender was able to return fire and stop the attack with a .22 single shot rifle.

What looks to be Justifiable homicide in NYC with a handgun?! Wow. I wonder how this is going to go.
Nobody is impressed by what you can't do. -THJ

The original article didn't specify and only used the word weapon. This article states he used a shotgun.

In New York you can use deadly force to prevent and terminate a burglary.

    3. A person in possession or control of, or licensed or privileged to
be in, a dwelling or an occupied building, who reasonably believes that
another person is committing or attempting to commit a burglary of such
dwelling or building, may use deadly physical force upon such other
person when he or she reasonably believes such to be necessary to
prevent or terminate the commission or attempted commission of such
    burglary.

It’s “another example of how a (concealed weapons permit) may save your life,” stated Spartanburg County Sheriff, Chuck Wright, after a concealed-carrier took down an armed robber and prevented another in a Waffle House full of customers.

I heard a lot of Monday morning quarter backing on this one, seems like the guy make a good judgement call to me.

I wouldn't have attempted to tell the robbers to "stay put" as the article stated. Bad guys forcing people to the floor and waving a gun would mean I'm engaging them straight away or I'm hauling tail for the nearest exit.
