In my experience, this is not that uncommon following OISs, particularly if the family or an attorney feel there are inconsistencies they perceive as unreasonable or unjust. Often they are just hoping the municipality throws them some money rather than the more expensive option of defending the suit all the way through a Federal trial.

Everything is fare game in discovery.
If the family wants to pursue this, at some point they are going to have to sit down with the lawyers and start answering questions about who they know, when they knew them, and where they meet them at.
