Wow. Can't say they did much right after they found the address. Get your checkbook out, Harris County.

Holy shit. I have no other words.

Over the years, I was personally involved in four incidents where we encountered armed homeowners/residents while responding to alarms or well-being checks. One of them was a minor national celebrity who was dating George Lucas at the time. As in....they had the gun in their hands as we encountered them. Two of those incidents we had guns pointed at us or in our direction. We didn't shoot any of those people.

On January 19, 2024, at 12:14 p.m., Olympic Division uniformed patrol officers conducted a want/warrant check on a white Dodge pickup truck. The inquiry revealed that the vehicle was reported stolen earlier that day and that the victim had left a firearm inside the truck. Once officers obtained an additional unit, and an Air Unit was overhead, they attempted to conduct a High-Risk stop on the vehicle. The driver, later identified as 32-year-old Mario Alvarenga, failed to yield and accelerated away.

Officers initiated a vehicle pursuit which was eventually taken over by Southwest Division uniformed patrol officers. Alvaranga continued into Newton Division and eventually collided with a parked vehicle at 12th Street and Paloma Street. Alvaranga exited the vehicle and ran into an occupied shipping facility, located on the 1100 block of East Pico Boulevard. Officers followed Alvaranga into the open business, and while inside, Alvaranga stopped and faced the officers. Alvaranga removed a handgun from his clothing and racked the slide in front of officers, resulting in an Officer-Involved Shooting. Alvaranga was struck by gunfire, fell to the ground, and was taken into custody.

Los Angeles Fire Department paramedics responded to the scene and transported Alvaranga to a local hospital where he was admitted for gunshot wounds. He is listed in critical, but stable condition. No officers or other community members were injured as a result of this incident.

A Sig Sauer, Model P365ss 9mm handgun, which was registered to the victim, was recovered from the scene and booked as evidence. The firearm was not loaded and its 12 round magazine was empty.

The LAPD’s specialized Force Investigation Division responded to the scene, interviewed witnesses, and supervised the collection of evidence by the Forensic Science Division personnel. The complete investigation will be reviewed by the Chief of Police, the Board of Police Commissioners, and the Office of the Inspector General to determine the thoroughness and accuracy of the investigation and whether the use of deadly force complied with LAPD’s policies and procedures

Isn't there a 10 round magazine capacity limit in California? The article indicated that the recovered gun had a 12 round magazine. If this is illegal, will the stolen car owner will be looked at by the police?

It’s not uncommon for burglaries and thefts to uncover items that incriminate the victims, and that can definitely lead to spin-off investigations.

People are protected by the 4th Amendment against unreasonable searches by the government, but if someone else breaks into your place/vehicle and finds stuff and turns it over to the police (intentionally or incidentally as in this case), the police can use that against you, as long as they did not direct the illegal search. They might run into some issues using a burglar/thief as a credible witness, but that’s an issue for the trial.

Back in early January Florida Man gets into dispute with his daughter and runs into her with his dually, shoots at responding cops and eventually rams two of the PD vehicles. This is recently released video that shows the crash, damn brutal, and the car that ended up under the truck had an officer in it, who survived. FM also survived, but it took six weeks or so, he just moved from the hospital to the jail. I cannot find a good article that is not behind a paywall but has been reported that a total of thirteen officers fired at him, and he was apparently many times.

Here at about 9:15 shows some officers setup in front of a solid backstop:

It's possible for California residents to legally possess >10-round magazines, either because they owned them before the mag ban, or if they bought them during Freedom Week. The P365 was released in 2018 and Freedom Week was in 2019, so it's at least possible. I guess the owner just needs to hope that if he did break the law that his mags don't have date codes on them.
