Clarity on Oklahoma CCW

Hi everyone! Not exactly sure where to post this, but I have a quick question about Oklahoma concealed carry law.

I'm moving to Oklahoma in August from Nevada and don't currently have an active CCW permit at the moment. My CCW license in my prior state expired a little while after I moved to Vegas here (and my prior state was a constitutional carry state anyway), and I'm barely staying in Nevada long enough to even justify getting a CCW since it takes 3-4 months to receive in my county.

Anyway, my question is how soon can I begin carrying in Oklahoma upon arrival? I know they are a constitutional carry state, but Ive read differing things in my online search. Do I need to get my Oklahoma drivers license and establish residency there before I can begin carrying? If so, am I good to go with the temporary license I'll be provided with at the license office?

Sorry if this is a stupid question, I just wanted to confirm before my move. I figured we may have some Oklahomans on the board who could clarify this for me. As you mentioned we area constitutional carry state now, so you should be good. If you have a current CCW card from another state (your post was kinda unclear) with a reciprocity agreement with OK they will honor it.

My understanding (see my link above) is that permitless carry is applicable to OK residents and some military/families only.
If my understanding is not correct, I'd appreciate the info.

I am also not a lawyer, so this isn't legal advice. The OSBI page you linked is talking about SDA licensing. OSBI is the Oklahoma SDA licensing authority.

I don't see a prohibition here:

As I understand it, as long as you aren't prohibited from possessing firearms or ammunition, you can carry concealed or unconcealed. There are places that you can't of course, and that goes whether you have a SDA permit or not. A lot of people are not renewing their SDA licenses due to CC. But if you do that you lose reciprocity with other states, so I maintain mine. If you never leave the state, "legally speaking" you don't need a SDA permit anymore in Oklahoma.

Sorry for the slow replies today guys. I want to thank you and @Spartan1980 for all of your information here, I really appreciate it! Based on my interpretation, it seems that I’m probably good to go on day 1. This link here (https://oklahoma.gov/governor/newsro...stitution.html) that Spartan posted makes me feel fairly comfortable with it. Since I’ll be getting my Oklahoma license pretty quick anyway, I think it is pretty low risk. I might still send an email to a lawyer my Dad (OK resident) knows just to be extra sure. Thanks again.

tangent question, my understanding of the rules on a national basis for Native American reservations is they make their own rules for concealed carry. There are a bunch of those in OK. How does that all work out? They follow the state rules mostly?

@fatdog This link is a pretty good one.

Tribes are all over the map (in a manner of speaking), in that they all have their own codes. Most tribal courts only deal with municipal code leaving criminal matters up to the feds, but there are a few rare exceptions. Also tribes also have their own differing agreements with the BIA and what the BIA allows them to handle on their own and tribal services vary greatly. As stated in that link, his info is only a starting point. It gets very time consuming trying to get a handle on what you can do and what you can't on tribal lands. It also happens to be that the tribes themselves don't even know what's allowed in some cases.

I looked into it a bit sometime back when I was considering moving onto tribal land. My ex-wife was a tribal member. This particular tribe also opened a gun range complete with machine gun rentals on tribal land! That got me interested in finding out just how that was possible. This particular tribe had a pretty solid firearms stance, as it turns out. That's not the case across the board.

Simplest functional way to look at it: Tribes don't have jurisdiction over non-natives but can set rules of conduct on tribal lands and remove or trespass violators similar to a private property owner. Tribal LE can stop, search, detain, hand-off to state, city, county, township, etc of jurisdiction when tribes have no jurisdiction of person. Offenses by non-natives can go federal or state/local, but doesn't go tribal.

Tribal ≠ federal. "Sovereign nation" doesn't mean what most think. It's patchworked and nuanced, but that's the gist.

What area are you moving to? I'm in the Tulsa metro. I'm not real familiar with Nevada's friendliness or not towards gun owners/shooters. But Oklahoma is about as good as it gets. At one point I had a metrosexual phase and wanted to live in a larger city with better coffee shop's and live jazz music etc. But about 10 years ago when I got back into shooting, I realized how great OK was to live. We have some great ranges and you can throw a rock and hit 2 or 3 pistol matches a weekend.

Why not call the Oklahoma Highway Patrol which must deal frequently with such questions?

The other bays weren't at capacity then, so I can't imagine that lack of capacity was the reason. And if they're canceling all matches, it doesn't sound like a personality conflict with any particular match director. Canceling matches seems like an easy way to less revenue.

Yes, my membership will lapse soon at USSA and I haven’t been since that was announced.

Oil Capital has multiple matches a month. So does Eric Fusion/Guns Of Glory in Bartlesville. Doing a search on Practiscore I see 2A has matches, several upcoming in Pawnee, Oklahoma City and more. It may take some driving, but between Steel Challenge, IDPA, USPSA and other less organized matches held at multiple clubs throughout the month, they are available. Add to that clubs in KS and AR if someone wants to compete they can fairly easily make a match a month without a lot of drive time.

Some of my competition buddies hit a match 3 out of 4 weekends a month for sure.

They have new management that was actually improving things a lot… but apparently they don’t value serious shooters. They’ve changed their business model to focus on walk in shooters. When the 2020 riots broke out and then the COVID lockdowns, etc their traffic basically quadrupled. I’ve been a member for 10 years and blew up seemingly overnight. And it doesn’t seem to be slowing down.

But yeah… I have my own private range now, so it’s been about 3 months since I’ve been there. I highly doubt I’ll ever shoot there again.

I’ll be moving pretty close to Tulsa, likely Broken Arrow. Really excited to get out there. My Dad loves it there, he’s on a small farm in Wagoner.

Is USSA still the place to go for a decent range? Do they still offer memberships? I don’t see anything about them on their website. I’m blown away that they quit running matches

Edit: just got this message from the asst. manager at USSA. Kind of a joke. $25/per day of shooting + no matches is super lame.

This is essentially it. I was a tribal cop in Nebraska for a number of years. In my case, I was cross-deputized/commissioned with the state, so I could enforce state law as well.

* Tribes can have jurisdiction over non-natives in domestic violence cases, if the tribal court system meets certain requirements. This came from the 2013 reauthorization of the VAWA.

Specifically regarding firearms carry... If I were to get stopped by tribal PD for some traffic infraction and was carrying a weapon, would there be any repercussions related to tribal laws?

I think what you've said above is... that tribal PD doesn't have jurisdiction over non-members, so, they can ticket me for the infraction (??) but cannot (?) arrest me for carrying on tribal roads even when tribal law might make it illegal (for tribal members) to do so... ??

Depends on your locale. For instance Oregon requires permission from the chief judge of the tribal court for a licensed canceled carrier on tribal land. I'm assuming that's law but could be wrong. It's definitely mentioned in the Oregon CCW course. So if it's state law and the tribal police are cross-deputized (not uncommon) it could be a problem.

Man that pisses me off. It was $20 last time I heard. I REALLY will avoid going there now and won't be nice about it if someone asks about their business. They've given the middle finger to serious shooters. The problem is... USSA is an excellent range. I've only been to a few in the country that are close to it. There are lots of other ranges though. Oil Capital Gun Club is probably going to be the main place now since they still offer matches. You do have to have a friend that's a member there to go shoot... or go to the matches. There's some indoor ranges like 2A and the Red Castle indoor range in tulsa. Also, again Guns Of Glory about 45 min from Tulsa. Suffice it to say, there's plenty of places to shoot, not just pay-to-shoot business ranges.

Some people may be surprised how metropolitan Tulsa and Oklahoma City are. There's a decent amount of larger city vibe and activities. But you drive 25 to 35 min in any direction and you're in places that are extremely open and rural. Lots of nice lakes and camp grounds, state parks etc. My own personal range is a 30 min drive south of Tulsa and it's a quaint area where there's 40, 50, 100 acre plots with single houses on them.

I do like living here quite a bit.

I have no idea about tribal law. I do know there are real tribal jurisdictions and from time to time I see tribal officers. I can say, I've NEVER been pulled over by a tribal officer and I've never heard of any person getting pulled over by one or anyone caught in a legal problem with tribal law enforcement of anything. Let alone carrying of firearms. Where you run into tribal law enforcement, it's usually in smaller towns.

I'm sorry I keep singing the same tune... Oklahoma is a very 2nd Amendment friendly state. It's my perception that any legal issues that do occur with non-tribal members are between the tribes and the cities/counties.

For purpose of this particular scenario and again functionally applied...

Cross-deputization doesn't change anything and does not expand jurisdiction - only options. It allows the officer to enforce rules of both legal constructs. A tribal officer that is cross-deputized as a state/county/city official can apply tribal law to those of it's jurisdiction, or state/county/city law to those of it's jurisdiction. If a non-native commits a tribal CCW violation they are still not subject to tribal jurisdiction, only state/county/city applies. If no state/county/city violation has occurred, it's not actionable.

Think of it in terms of traffic: A state highway bisects a reservation and there is parallel law in both tribal and state code such as a speed limit. Tribal officers can cite natives to tribal court, and then non-natives to state court. This isn't uncommon. Similarly, state/county/city officials can also be cross-credentialed as tribal officers with the same effect, but that is less common usually for reasons of sovereignty and local politics.

As @Chuck Whitlock notes, it gets more complicated with some types and levels of violation - such as VAWA, or civil matters. There's also some quirks in intersections of federal, state, and tribal fish and wildlife law.

Yeah, pretty much knew all that. My fault for not being clear I'm sure. I was referencing the ability to enforce state laws against non-tribsl members where cross-deputized.

USSA is a great looking facility, but they seem to have trouble keeping consistent operations. It could be amazing. I remember when the Tac Conference was there. I lived about 10 miles away. It was nice.

Also thank you, what I am taking from this is if one is driving across any res, in most states at least, and CCW'ing in compliance with state law, there is nothing that puts you in real legal jeopardy. Based on bad info in the past I have gone to the trouble of taking off the gun, unloading and stowing it to cross a big reservation stretch in my vehicle if I knew the tribe prohibited CCW on the res. E.g. Wind River, Pine Ridge, etc. I am reading that is really not necessary if I intend to make a more or less continuous journey and I am in compliance with state law.

Cross-deputization doesn't change anything and does not expand jurisdiction - only options. It allows the officer to enforce rules of both legal constructs. Also understand that most, if not all, reservations are not walled-off with border guards. IIRC, Oklahoma in particular doesn't really have reservations within a defined border, and tribal lands are kind of a checkerboard arrangement.

As @ST911 stated, things can get complicated. Tribes are separate sovereign entities, generally (in a legal sense) with the same status as the various states, but are also somewhat protectorates of the US government as well. One training that I was required to attend was Jurisdictional Issues in Indian Country (something like that). The class I attended was put on by the US Attorney's Office for the District of Colorado. Although it was mainly for tribal and BIA officers, per the instructors it was structured more like it was for 2nd year law students.

Jurisdiction (state/tribal/federal) is determined by level of crime (Major Crimes Act) and by whether actor and victim are Native or non-native. There can be concurrent and/or exclusive jurisdiction.

It's truly sad what's happened to USSA. I was lucky enough to shoot many matches there back in it's heyday. Oil Capital is a good one but I haven't made it over there in a long time. I used to shoot the practical rifle match every month, also a few USPSA matches. Oklahoma is positioned to where you can shoot a match every weekend if you can drive a bit. I used to do that alot, OKC, Ada, Duncan, Ponca City, Tulsa, Wichita Falls or Ft. Smith were on the agenda every weekend. I only had trouble deciding which matches I was going to shoot! I miss those days.

Yeah thanks for backing me up on all the matches in the area. You just have to plan to drive a little. I’m dealing with a bad case of tennis elbow so I haven’t competed in a few months. But when I can shoot, I hit 2 or 3 matches a month.

I suppose we should clarify what types of matches so we don't confuse the OP. It sounds like they are moving around Tulsa, which is better for options. There are options for a variety of matches if you include rifle stuff. But if you live in the OKC metro area there is only one club within 2 hrs that shoots matches. Duncan doesn't do USPSA anymore and neither does Ponca. If you're in Tulsa you can drive to AR. But for me it's about as close to drive to Wichita Falls as Guns of Glory.

There are certainly worse areas and maybe it's because I know people who can shoot USPSA every week if they want, but I wouldn't call OK a strong state for matches. Tulsa, yes but not Oklahoma. But I only shoot USPSA and I'm viewing it through that tinted lens. It seems to be dying here.

Wellington Kansas is in range too. They do GSSF, Steel Challenge and 3 Gun. Some others too.

I understand the owner's son is going to try to set up USPSA matches in the future. Don't know what the time frame is though.
