View Full Version : Washington state residents: How to legally sell or ship an AR after HB1240?

Trying to help a family member who lives in Washington state and wants to move along an AR owned before the new laws came into effect.
He’s contacted multiple FFL dealers about selling to them or using them to ship to an out-of-state FFL where ARs are legal. None of them will help. All say they legally can’t because of HB1240.
I’ve read the law and along with grandfathering any AR owned before going into effect, it clearly states that any FFL dealer can purchase an AR from residents and resell out-of-state, or ship to an FFL in any state where legal to own.
What am I missing, and what are his options?

You may suggest that they use shipmygun.com to ship out of state. They don't need to go through an FFL to do that as long as they ship to an FFL.

The laws are poorly written, and no one wants to be a test case.
Gun stores are all waiting to see what the other one does and what happens.
The AG in our state is an idealist crusader. His MO is to sie business is out of existence.

The fucking state just got around to publishing the law as signed by the governor, SUBSTITUTE HOUSE BILL 1240, to define what constitutes an "assualt weapon". See - https://app.leg.wa.gov/RCW/default.aspx?cite=9.41.010
RCW 9.41 is the law that deals with firearms and dangerous weapons.
Fuck cowardly FFLs in Washington state that are unable to read and comprehend a simple law.

I think the answer to your question is they can sell those rifles, just not in WA.
SB 5078 is another thing WA dealers have to consider now, even if they sell a firearm out of state.

I've talked to several dealers about this. One still does transfers but won't sell anything. One stopped selling and now just does transfers and gunsmith work. The 3rd one had a substantial business selling. He went out of business.
Things are not good for dealers here.
I was considering selling a few pistols but the way things are going here, with the increased difficulty buying anything, I'm just going to put them in the back of the safe and forget I own those.
