Yes, it’s illegal to threaten to kill people in most states.

They were not friendly with Mr Klingseisen. In fact, the woman walking with Kirchner, Elaine Natore, had a "no contact" order against Mr Klingseisen,

Totality of the circumstances...insert Paul Harvey "rest of the story" here.

Apparently all you have to do is feel threatened and you can have someone arrested.

Except for Antifa loving progressive cities where you can beat people with sticks and police are told to stand down.

FWIW, this guy was convicted of a summary offense- the lowest grade of crime in PA. Summary offenses are like traffic tickets- he was issued a non-traffic citation (ticket.) The original court- a local magistrate, after a summary hearing found the defendant guilty and sentenced him to pay a fine of $100.00 plus court costs.

Defendant appealed his conviction. After a new hearing, the county judge found him guilty. Same fine & costs imposed.

Defendant appealed his conviction. The PA Superior Court upheld his conviction.

The court concluded that Kirchner’s conduct “caused the very harm sought to be prevented by the law defining the offense.”

Here's the Superior Court's brief

ETA: Summary offenses (except retail theft: ) no finger prints

From the testimony:

Mr Klingseisen also said that Kirchner's gun-like hand gesture made him feel "extremely threatened," according to testimony.

Apparently if you provoke someone with the bird hand gesture, you are OK. Maybe Kirchner should have said he felt extremely threatened with Klingseisen's gesture and acted in self defense. ;)

Kirchner, wearing basketball shorts and flip-flops, said that when he stopped, Mr Klingseisen flipped him the bird - "with both hands," he testified.

He was never arrested. He was ticketed.

Read the decision, not just that snippet.
