I've been searching for the forms and process to create an SBS/SBR and nearly everything I've found is focused on guides about trusts. I'm totally new to the NFA, and my question might seem straightforward to some, but I'm curious about what is required to manufacture an SBS/SBR from an existing shotgun/rifle/firearm. I don't know any specific firearm lawyers to ask, and gun shops in my area only know about how to transfer silencers/SBRs to a trust. Can someone create a quick guide for mid-2017 laws that I can follow to submit forms as an individual?

Thanks

Registration of an existing firearm as an SBR/SBS is done on the BATFE form 1.

The difference between an individual and a trust is which box is checked in section #2, and filling out #11-14 if registering as an individual. Reading the instructions on the linked form (easy) and trying to understand what it means (not as easy?) will give you a good base for asking further specific questions.

If your dealer doesn't know how to help an individual submit the form, I would be very wary about using them for anything. If you would state where you live, you might get some recommendations for better dealers.

With all the access restrictions that come with NFA items, and the additional access restrictions that come with registering an item to an individual, are you sure you don't want to do a trust?

The usual qualifiers apply: I'm not a lawyer, not an expert, ymmv...

Seek, and ye shall find: https://www.atf.gov/firearms/national-firearms-act-handbook

Before I started dipping a toe in the NFA waters, I read the BATFE NFA Handbook at the above link.

I live in Virginia. The few gun shops I've asked around are either not knowledgeable due to not being Class 3 dealers or unwilling to help due to it not being an NFA purchase/transfer. It would seem that the Class 3 dealers I've been to are more than happy to create a trust for me and assist with the paperwork, but it would require me to buy one of their silencers or NFA firearms first. They were not so willing to help with those processes when I told them I planned on "manufacturing" one of my own existing firearms. However, my situation is such that I am the only person with access to my firearms and I'd be present if they're being used by other people.

Thank you. In regards to the CLEO copy... Do I send the form 1 copy to the personal office of the Chief of "X Police" Department?

As for NFA Handbook, be advised it is several years out of date and has erroneous information.

You're located less than an hour from me. I actually sent you an email last night asking about your Silencer Shop Kiosk. I think I'd be able to do the Form 1 as in individual on my own, however I'd do it by a trust if I had assistance. Do you help with setting up trusts on site/by appointment?

I recommend going to Hansohn Brothers above. I've purchased suppressors though them, great folks good prices. They can hook you up with the info you need, but I will warn you, NFA stuff is addicting.

I thought your user name looked familiar. ;) I'm a little old school and recommend an attorney draw up your trust. For Virginia residents, look no further than John Pierce. https://johnpierceesq.com/nfa-trusts/

The one thing we do offer that most shops don't, we have a livescan fingerprint station plus we can take your photos. Once in our system, you can order anything online and have the forms mailed to you to complete or we can utilize Docusign and accept your signature electronically. You get all that for $35.

That sounds perfect. Pierce's trust setup sounds super easy to get setup. I'll be in touch once it's set up to do the paperwork.
